The U.S. immigration law allows foreign nationals to invest in and manage businesses in the United States. Prior to managing businesses in the U.S., foreign investors must apply for and be granted the appropriate immigration visas allowing them to work for their enterprises.

Depending on the monetary value of the investment and job creations in the U.S., a foreign investor may be eligible for a permanent resident status (green card) or temporary investment visa. The following are the most commonly granted investment visas:

• Visas for Treaty Traders and Investors (E-1/E-2 Visas) These visas allow foreign investors and traders and their employees to manage their businesses in the U.S. if their home country has a commercial treaty with the U.S. conferring visa eligibility.

• Intracompnay Transferee Visas (L-1 Visas)  These visas permit foreign companies with operations (investments) in the U.S. to transfer their foreign managers/executives and specialized personnel to the U.S.

• Immigrant Visas for Investors (EB-5 Visas)  These visas may be issued to foreign nationals who invest between $500,000 and $1,000,000 in a job-creating enterprise in the United States.
